The rules, usage rights, billing conditions, and service limitations that apply when using Pixelixe products, APIs, and related services.
These Terms of Service ("Terms") govern access to and use of the Pixelixe website, Pixelixe Studio, Pixelixe APIs, template automation workflows, white-label editor integrations, demos, and related support or content (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You agree to provide accurate account and billing information, keep that information current, and maintain the confidentiality of your login credentials, API keys, tokens, and other access methods. You are responsible for all activity that occurs through your account unless you promptly notify Pixelixe of unauthorized use.
Subject to these Terms, your plan limits, and applicable law, Pixelixe grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal use. Depending on your plan and feature set, this may include creating layouts, editing templates, exporting graphics or PDFs, processing images, using APIs, automating image generation, or embedding the editor into your product.

You retain your rights in the content, images, logos, fonts, prompts, spreadsheet rows, API payloads, and other data you submit to the Service ("Customer Content"). You grant Pixelixe and its service providers a limited license to host, copy, transmit, transform, render, and process Customer Content only as necessary to provide, secure, maintain, support, and improve the Service, or to comply with law.
You are solely responsible for Customer Content and for ensuring that you have all rights, notices, permissions, and lawful basis needed to upload, process, or distribute it. You are also responsible for reviewing all outputs before use. Pixelixe does not guarantee that generated, automated, or AI-assisted outputs will be unique, error-free, or free from third-party claims, and you remain responsible for publication, distribution, advertising compliance, and downstream use.
If you use Pixelixe APIs, automation workflows, or an embedded or white-label editor, you are responsible for securing your keys, access tokens, and end-user environments. Pixelixe may impose or update technical limits such as rate limits, concurrency limits, file size limits, storage limits, or plan restrictions. Pixelixe may throttle, suspend, or block requests that create reliability, billing, abuse, or security concerns.
If you embed Pixelixe inside your own SaaS, marketplace, website, or internal tool, you are responsible for your own end-user notices, product terms, privacy notices, permissions, and compliance obligations. The ability to embed or white-label Pixelixe is limited to plans or agreements that expressly allow it.
Enterprise, OEM, agency, or custom white-label deployments may also be governed by a separate written order form, statement of work, or data processing agreement. If a signed written agreement conflicts with these public Terms, the signed written agreement will control for the covered services.
The Service, including Pixelixe trademarks, software, designs, visual components, documentation, site copy, and other Pixelixe-originated materials, is owned by Pixelixe or its licensors and is protected by applicable intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
If you send Pixelixe ideas, feedback, requests, suggestions, or feature proposals, you agree that Pixelixe may use them without restriction or compensation, and without any obligation to keep them confidential unless otherwise agreed in writing.
The Service may rely on third-party infrastructure, payment providers, storage providers, analytics tools, content delivery providers, or external URLs supplied by you. Pixelixe is not responsible for third-party services, content, or business practices, and your use of third-party products remains subject to their own terms and policies.
Paid plans are billed in advance on the monthly or yearly cycle displayed at checkout and automatically renew until cancelled. You authorize Pixelixe or its payment provider to charge the applicable fees, taxes, and similar charges using your selected payment method. Unless expressly stated otherwise, fees are exclusive of taxes and you are responsible for all applicable taxes, duties, and similar assessments other than taxes based on Pixelixe net income.
Except as required by applicable law or expressly stated on the Site, fees paid for an active billing period are non-refundable, and Pixelixe does not provide refunds or credits for partial months, unused capacity, setup work, or downgrade differences. Pixelixe may update pricing prospectively with notice. Failed or disputed payments may result in retries, service restrictions, or suspension until the outstanding balance is resolved.
Pixelixe may add, modify, replace, or discontinue any part of the Service at any time. Preview, beta, alpha, early-access, or experimental features are provided on an "as is" basis and may be changed or withdrawn without notice. Public roadmap material, demos, examples, and marketing pages are informational only and do not create a binding commitment to ship any feature or integration.
You may cancel the renewal of a paid subscription through the available billing workflow, your payment provider workflow, or by contacting inquiries@pixelixe.com. Cancellation stops future renewal charges but does not retroactively refund the current billing period unless required by law.
Pixelixe may suspend or terminate access to the Service, in whole or in part, with or without notice, if we reasonably believe that you breached these Terms, failed to pay fees, created security or legal risk, abused the Service, or used the Service in a way that could harm Pixelixe, its users, or third parties. Upon termination, your right to use the Service ends immediately. Pixelixe may delete or disable access to Customer Content after a commercially reasonable period, subject to backups, logs, legal obligations, and operational retention cycles.
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, or error-free operation. Pixelixe does not guarantee that the Service will always be available, secure, or compatible with every browser, device, integration, or third-party provider.
To the maximum extent permitted by law, Pixelixe will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, customers, reputation, or business opportunity, arising out of or related to the Service, even if Pixelixe was advised of the possibility of such damages. Pixelixe's aggregate liability for all claims arising out of or related to the Service will not exceed the total amount paid by you to Pixelixe for the Service during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law so requires.
You agree to defend, indemnify, and hold harmless Pixelixe, its affiliates, service providers, officers, employees, and contractors from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your Customer Content, your use of the Service, your end-user implementation, your breach of these Terms, or your violation of law or third-party rights.
Unless mandatory law requires otherwise, these Terms and any dispute arising out of or related to them are governed by the laws of France, without regard to conflict-of-law rules. The competent courts of Paris, France will have exclusive jurisdiction, except to the extent applicable consumer or mandatory law provides another required forum.
Pixelixe and you are independent parties, and these Terms do not create a partnership, joint venture, agency, employment, or franchise relationship. These Terms constitute the entire agreement between you and Pixelixe regarding the Service and supersede prior discussions on the same subject. If any provision is held unenforceable, the remaining provisions will remain in effect. Pixelixe may assign these Terms in connection with a merger, reorganization, or sale of the business. You may not assign these Terms without Pixelixe's prior written consent. A failure to enforce any provision is not a waiver.
Technical support for the platform is generally provided by email. Pixelixe may send you notices electronically, including by email, account notification, or by posting updates on the website.
